Warranty Information

 WARRANTY
(As of January 1, 2002)

20 YEAR WINDOW AND PATIO DOOR FRAME WARRANTY 
Modern warranties our vinyl or aluminum frames from defects due to workmanship for a period of 20 years. We offer a 10 year warranty on any custom-painted frames, some exclusions apply.

10 YEAR SEALED GLASS WARRANTY 
Modern warranties sealed glass within our vinyl windows and patio doors for 10 years. Exceptions include units with any grids, tempered glass in windows, and tinted glass – there will be a 5 year warranty on these units. 

2 YEAR HARDWARE & LABOUR WARRANTY 
Modern warranties all hardware parts found to be defective due to material or workmanship for a period of 2 years from the invoice date. Damage and issues that arise from normal wear and tear are not included in the warranty. Modern also offers a 2 year warranty on supply & install labour. On supply only sales, it is the purchaser’s responsibility to inspect the product for damage and/or defect at the time product is received or picked up, and any concerns must be reported to Modern within 2 business days, as Modern will not be responsible for any labour required to subsequently remove and/or reinstall supply only product.

SEALED UNITS 
Sealed units that are installed into other manufactures frames will have a warranty of 5 years against failure.

WARRANTY EXCLUSIONS

  • - Normal wear and fading 
  • - Painted hardware & components
  • - Painted sill track
  • - Improper storage, handling, installation, finishing, use, modification or maintenance
  • - Non-factory-applied finishes, sealants or caulking
  • - Damage caused by failing to finish or install in a timely manner to protect them from the elements
  • - Any scratches, chips or abrasions that have not been reported and repaired immediately
  • - Cracked or broken glass, torn screen fabric
  •  -Damage caused by circumstances beyond the control of Modern
  •  -Products which in the sole judgment of Modern have been improperly installed
  •  -Defects in wall construction
  •  -Product subjected to misuse, abuse or stress caused by a building settlement or structural movement
  •  -Product treated with a liquid set coating or had a plastic film applied
  •  -Product installed in close proximity to a swimming pool, hot tub or similar structure
  •  -Damage caused by high in-home humidity (condensation, frost, and mold)
  •  -Modern will, in no circumstances pay any third-party charges if we have not authorized the specific amount of the payment in writing before the work is performed.
  • - Any lifting device or staging required to repair or replace a window component under the warranty is not covered and will be the responsibility of the customer
  • ​- Product that has not received normal yearly maintenance as herein described:
  • - Inspect, clean and lubricate moving parts such as hinges, locking handles, rota operators, multi-point locks, wheels and rollers
  • - Inspect and clean inside track of horizontal sliding windows
  • - ​Inspect exterior weep holes and endure they are clear of dirt, debris or obstructions which would restrict drainage to the outside of the window

LIABILITY

  • - This warranty is expressly in lieu of all other oral or written warranties, liabilities, or obligations of Modern. No representative of Modern is authorized to make changes or modifications to this warranty.
  • - In no event shall Modern be liable for consequential or incidental damages of any kind, including damage to persons, the building, or its contents. Purchase and use of these products is at your own risk.

GENERAL

Modern warrants that products manufactured by Modern will be free from defects in material or workmanship for the warranty periods specifically set out below. If during a Warranty Period a Modern product is found to be defective:

- Modern may elect, in its sole discretion, to either repair or provide a replacement for the defective product or component within the warranty terms as listed.

- If Modern determines that repair or replacement are not practical or cannot be carried out in a timely manner, then Modern may elect to refund the original product purchase price.

- The specific remedy (which includes consideration of logistics, timing and related costs of the claim selected under this warranty), will be at the sole option of Modern in every circumstance.

- Warranty of any replacement item will be limited to the remainder of the warranty period of the original purchase

- Shipping Charges on Supply Only sales:

For two years from the date of sale of your Modern manufactured windows, no shipping charges will be incurred by the consumer for a replacement product or component. After two years from the date of sale, a replacement product or component will be delivered to the closest Modern service location for pickup by the consumer at no charge. If shipment direct to the consumer is requested, the consumer will pay for the shipping and handling charges.

Modern reserves the right to modify or discontinue any of its Products. For the repair or replacement of modified or discontinued Products, Modern will have the right to substitute current Products and components of equal quality and as similar in appearance as possible. Modern will not be obligated to replace discontinued Products and components for which no similar alternatives are available.

SUPPLIERS WARRANTIES 

We also stand by the manufacturers’ warranties for all other products we carry and handle all claims within their terms of reference. 

This warranty applies to the original purchaser and all subsequent owners
No warranty applies to product that has not been paid for in full
